Three suspects already facing murder charges over the killing of Dr Victoria Mutiso are set to face fresh charges in connection with the alleged murder of prominent Nairobi lawyer Mathew Kyalo Mbobu.

The Director of Public Prosecutions (DPP) has approved murder charges against the three suspects alongside two police officers accused of being involved in Mbobu’s killing.

In a statement issued on Thursday, October 8, the DPP confirmed that charges had been approved against the five suspects after investigations linked them to the lawyer’s death.

"The Director of Public Prosecutions (DPP) has approved murder charges against five suspects accused of killing lawyer Mathew Kyalo Mbobu," the DPP stated.

"The suspects are politician Rose Mbithe Mulwa, her two children, Chris Mulwa and Angela Mulwa, and two police constables, Julius Kipkoech Cheruiyot and Kennedy Kipkemei Borboroi," the prosecution added.

According to the DPP, the five suspects will be prosecuted over the alleged murder of Mbobu, who was shot in a drive-by attack along Magadi Road on September 9, 2025.

The development comes as three of the suspects are already facing separate murder charges over the killing of Dr Victoria Mutiso, who was shot dead in Upper Hill, Nairobi, on July 29, 2026.

Investigators intensified the Mbobu probe following the arrest of a police constable on September 24. Detectives suspect the officer was the gunman involved in the shooting that claimed the lawyer’s life.

Following the DPP’s approval of the charges, the two police officers were presented before the Kibera Law Courts. However, they declined to take a plea.

The court subsequently ordered that the officers undergo mental assessments at Mbagathi Hospital to establish whether they are mentally fit to stand trial.

The five suspects are expected back in court on October 27, when they are scheduled to take their pleas after the court receives the mental assessment reports for the two officers.

Meanwhile, the Directorate of Criminal Investigations (DCI) continues to pursue a police inspector who has emerged as another suspect in the case. Investigators allegedly linked the inspector to coordinating the operation.

Detectives are continuing to investigate both Mbobu’s and Dr Victoria’s killings, pursuing additional leads to establish the circumstances surrounding the two incidents, including the alleged motive, planning and execution.
